Terms of Service

1. Agreement

By creating an account or using PingSetu, you agree to these Terms on behalf of yourself and the business you represent. If you do not agree, do not use the service.

2. The service

PingSetu provides a shared inbox, CRM, automation, campaigns, AI agents and related tools for WhatsApp, Instagram and Facebook Messenger. Features marked "coming soon" (such as SMS, RCS and Telegram) are not part of the service until released. We may improve or change features over time.

3. Accounts

• You must be 18 or older and give accurate information.
• You are responsible for your team's logins and all activity under your account.
• Tell us promptly at hello@pingsetu.ai if you suspect unauthorised access.

4. Meta channels and messaging rules

WhatsApp, Instagram and Messenger are provided by Meta. By connecting them you also agree to Meta's terms, including the WhatsApp Business Policy and Commerce Policy.

• You must obtain opt-in consent before messaging contacts on WhatsApp.
• Template approvals, quality ratings and messaging limits are decided by Meta.
• Meta's per-message conversation charges are separate from PingSetu subscription fees.
• We are not responsible if Meta restricts or suspends your number or account.

5. Acceptable use

You agree not to use PingSetu to:

• Send spam, unsolicited bulk messages or messages to people who opted out.
• Send illegal, fraudulent, deceptive, hateful or infringing content.
• Break India's telecom, IT, consumer protection or data protection laws.
• Probe, overload, reverse-engineer or disrupt the platform.
• Resell the service except through our partner program.

We may suspend accounts that break these rules.

6. Your data

You own the content and contacts you bring into PingSetu. You give us permission to host and process it only to provide the service. Our handling of personal data is described in our Privacy Policy. You can export your data before closing your account.

7. Plans, billing and refunds

• Paid plans are billed in advance, monthly or yearly, and renew automatically.
• Prices are in INR and exclude GST and other applicable taxes.
• You can cancel anytime; access continues until the end of the paid period.
• Fees already paid are non-refundable except where required by law.
• We may suspend service for unpaid invoices after giving notice.

8. Reseller partners

If you resell PingSetu under your own brand, the partner agreement also applies and you are responsible for your clients' compliance with these Terms. If you are a client of a partner, your billing and first-line support are handled by that partner.

9. AI features

AI-generated replies can be inaccurate. You are responsible for configuring agents, reviewing their output and deciding when a human should take over.

10. Intellectual property

PingSetu, its software, design and brand belong to us. These Terms give you a limited, non-transferable right to use the service during your subscription.

11. Disclaimers and liability

The service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability is limited to the fees you paid us in the 12 months before the claim.

12. Termination

You may close your account at any time. We may suspend or end access if you break these Terms or the law. Sections that by nature should survive — such as liability and intellectual property — continue after termination.

13. Governing law and contact

These Terms are governed by the laws of India. We may update them and will change the date above; continuing to use the service means you accept the update. Questions: hello@pingsetu.ai.
